Newcastle courthouse. A MAN who is accused of choking his sometime partner until she blacked out, burying her mouth and nose in sand so she couldn’t breath and crushing an aluminium can against her throat during an alleged prolonged domestic violence attack will face a trial in Newcastle District Court next year.
Brian Andrew Kaiser, 45, of Shortland, appeared in court last week via audio visual link from jail where he pleaded not guilty to a number of charges, including two counts of intentionally choke person with recklessness, assault occasioning actual bodily harm, two counts of intimidation and destroy or damage property.
During the four month on again, off again relationship, Kaiser is accused of continually threatening to hurt or kill the woman and her children, as well as harassing, stalking and accessing her Facebook account, according to court documents.
“You know the consequences of what will happen if you don’t stay with me,” Mr Kaiser is alleged to have told the woman in May this year.
“I will kill you if you leave me.”
The woman told the police Mr Kaiser “followed her” and “imposed himself on her plans” when she went to Redhead beach on May 12 this year.
While there about 9pm, the woman alleges Mr Kaiser began abusing and threatening her before grabbing her by the throat and forcing her to the ground.
He allegedly sat on the much smaller woman’s chest, pinned her arms and choked the woman until she blacked out and was unable to resist, police allege.
Mr Kaiser is accused of emptying the woman’s bag onto the sand before the woman woke up and began picking up all of her property.
Mr Kaiser then allegedly grabbed the woman from behind and forced her to the ground, pushing her face into the sand so both her mouth and nose were covered and she had to breath in sand, according to court documents.
Then, about 30 minutes later, Mr Kaiser allegedly pressed an aluminium can into the woman’s throat until it was completely crushed.
Mr Kaiser will appear in Newcastle District Court on February 1 to get a trial date.
